Mr. Mark B. Lehnardt counsels foreign producers and U.S. importers in U.S. antidumping (AD) and countervailing duty (CVD) investigations, related proceedings, and litigation. He also provides assistance to U.S. producers and exporters subject to foreign AD and CVD investigations. Mr. Lehnardt has both led and supported investigation defense teams before the U.S. International Trade Commission (“USITC”) and the U.S. Department of Commerce (“USDOC”). Mr. Lehnardt typically focuses on legal argumentation in administrative proceedings and litigation, where he has significant experience and an outstanding track record. His recent, significant litigation victories include the exceptionally-rare reversal of a USITC affirmative injury finding, resulting in revocation of AD and CVD duty orders; the successful challenge to a 20-year-old USDOC regulation, resulting in the reduction CVD duties by over 350 percentage points in the specific investigation at issue; and the successful protection of due process rights by limiting the extent to which WTO proceedings can supersede U.S. domestic litigation.
Mr. Lehnardt believes in just causes, and believes that the government oversteps the bounds of its discretion too frequently. He thrives on fighting for those who have been wronged. Thus, he takes on difficult cases and strives to change unfair and prejudicial interpretations of the law.
Mr. Lehnardt has lectured in law faculty settings in China, Turkey, and the USA, and has presented training and information to industry groups and foreign government officials from China, Turkey, and Latin America.
Mr. Lehnardt’s international trade practice began with a two-year clerkship with the U.S. Court of International Trade (“CIT”), followed by four years as a government official in the USDOC. At the USDOC, Mr. Lehnardt represented the United States and AD and CVD litigation before the CIT, the Court of Appeals for the Federal Circuit, and the WTO.
Mr. Lehnardt previously worked as a commercial litigation associate in a large firm defending natural-resource clients; as in-house counsel at a multinational corporation overseeing international-corporate, international-trade, and Latin America legal affairs; and as a summer associate for a law firm in Lima, Peru. He volunteers time in the local ministerial alliance, senior assistance organization, and community youth soccer league. He has traveled throughout the Americas, Europe, Asia, and Oceana.
